La Plata, MD – When a judge tells a defendant not to violate any of the conditions of his or her probation, it is never good when the advice goes unheeded.
So it was for Michael David Gordon, 33 of Bryantown, who appeared before Charles County Circuit Court Judge H. James West Thursday, Sept. 10.
Charles County Assistant States Attorney Frank Granados told West that since a hearing before the judge in August, Gordon, who was told to remain in St. Maryโs County while on probation, has stayed outside of the Mother County of Maryland several times.
โOn Aug. 14 through Aug. 17, he stayed in Charles County at a residence in Pomfret, in Calvert County at North Beach Aug. 18-19, and in Pomfret again Aug. 20-22,โ Granados stated. โThe state is asking that he be held without bond. Obviously, he canโt follow simple instructions.
โHe is a registered sex offender,โ he added. โHe disregarded the stateโs instructions. This is clearly a violation. The state renews its request for Mr. Gordon to be held without bond.โ
Attorney Leonard Castille stated that his client has a legitimate job working in Upper Marlboro.
โHe was picked up this morning at his place of employment,โ he said. โI told Mr. Gordon that the first thing we needed to do is to get him out of being homeless. He has a lease with Mr. Murphy, who lives in Pomfret. Two of these violations were at his new lease.โ
โI no longer want to be homeless,โ Gordon told the court. โIโm trying to do the best I can.โ
โLooking at what the state wants,โ Castille said, โthe state wants to revoke his bond and give him eight years of backup time. Iโm asking you to release him and remove the GPS from his person.โ
โOn the dates that I stayed outside of St. Maryโs County, I was at the home of Mr. Murphy and my girlfriend in North Beach. I didnโt leave to go back to St. Maryโs County,โ Gordon explained. โEvery other night I spent at the park and ride in Charlotte Hall.โ
โEvery time he appears in court he has a new excuse,โ Granados stated.
โItโs clear to me youโre in a tough situation,โ West told the defendant. โYou shouldnโt have to choose. You had a decision to make whether or not you should stay in the county youโre required to stay in. We had a hearing in August. It takes you nearly no time at all to violate your probation. Bond is revoked,โ he stated.
