At about 9:00 p.m. on July 25 Dfc. Richard S. Wilson was traveling south on Md. Rt. 4, in Dunkirk,ย  when he observed a red Ford Mustang leaving the parking lot of a closed business.ย 

An MVA check of the vehicle tags revealed they were registered to a Toyota passenger car.ย  Wilson initiated a traffic stop.ย 

The passenger in the car, later identified as Andrew R. Brady, 22, of St. Leonard, was actually the owner of the vehicle and also the owner of the Toyota tags.ย  Brady indicated that the vehicle was new and he had transferred the tags.ย 

The driver of the vehicle, later identified as Justin P. Garber, 24, of Broomes Island, was found to be driving on a suspended license.ย 

A search incident to arrest revealed Garber to be in possession of heroin and drug paraphernalia.ย 

Garber was arrested and charged with driving on a suspended license, possession of heroin and possession of drug paraphernalia.ย 

The vehicle was searched and a bag was found that contained heroin and drug paraphernalia.ย 

Brady indicated that the bag was his.ย  He was subsequently arrested and charged with possession of heroin and drug paraphernalia.
