Prince Frederick, MD – A man who told police he was helping those he sold heroin to โ€œget wellโ€ was indicted in Calvert County Circuit Court last month. The indictment handed down Nov. 21 against Mark Steven Garner II, 28 of Lusby includes four felonies among the eight counts. The felonies include two counts of controlled dangerous substance (CDS) possession with the intent to distribute narcotics and two counts each of CDS possession with intent to distribute.

In a statement of probable cause filed with District Court of Maryland, an undercover detective with the Calvert County Sheriffโ€™s Office stated a circuit court judge signed a search and seizure warrant Sept. 29 allowing members of the agencyโ€™s Special Operations Team (SOT) and Drug Enforcement Unit to enter a house on Danielleโ€™s Way in Dowell. โ€œUpon executing the search warrant, Mark Steven Garner was located on the couch in the living room of the residence,โ€ the detective stated. Two adult females, a female teen and an infant were also in the house at the time. โ€œAll household members were located and secured by members of SOT,โ€ the detective stated. โ€œNumerous items of evidence were located within the residence and seized.โ€

The officers found approximately seven grams of suspected heroin along with several capsules and syringes, the detectiveโ€™s account indicated.

According to the statement of probable cause, a detective heard one of the females declare โ€œMarkโ€™s been selling heroin.โ€ The undercover detective who filed the statement reported that Garner was read his rights and chose to speak with detectives without a lawyer. When the detective asked Garner how many people he was giving heroin to, the defendant replied, โ€œyou mean how many people am I helping get well? About a handfulโ€”about five or six.โ€ The court documents also indicate Garner has admitted to using heroin himself. Garner was also asked about his source and supply for the heroin he uses and sells. However, the information was not documented in the statement of probable cause.

Detectives interviewed one of the women in the house. The undercover detective filing the court statement reported that he knows the woman to be โ€œa heroin user.โ€ The woman told the detective, โ€œI know he [Garner] helps out a handful of peopleโ€ but wasnโ€™t sure how many.

Garner is currently incarcerated in the Calvert County Detention Center and a status conference on his case is tentatively scheduled for Dec. 21.
