Lexington Park, MD— On Feb.5, ย St.Mary’s County Sheriff’s Office Deputy Austin Schultz responded to Liberty Street in Lexington Park for the report of an assault.ย
When Schultz arrived on the scene, he made contact with the victim and her boyfriend, Brian A. Hicks, 35, of Lexington Park. The victim advised she and the defendantย were in a verbal argument over the two separating.ย
During the argument, “the defendantย put his hand over the victims mouth. The victim advised after a brief struggle she was able to free herself from the defendant,” according to charging documents.ย
However, during the processes, ” the back of her (victim) ear was cut,” according to charging documents. I (Schultz) observedย blood behind the victim’s right ear as well as redness on the right side of her neck and face.” According to charging documents, “it appears the back of the victim’s earring cut the back of her ear during the struggle.”ย
Hicks was placed under arrest and transported to St. Marys County Detention Center where he was charged with second-degree assault.ย
Hicks as a court date schedule for April 21 at the St.Mary’s County Disrtict Court. He faces a maximum jail sentence of ten years and/or a maximum fine of $2,500.ย
